Within the framework of Phonegate, following is the list of legal actions in progress against mobile phone companies:
Xiaomi – Redmi Note 5 and Mi Mix 2S mobile phones
On April 15, 2019, the first criminal complaint within the framework of Phonegate was filed with the Paris Public Prosecutor against the Chinese mobile phone manufacturer Xiaomi by Attorney Elias Bourran of the Paris Bar and a class action lawsuit launched against the company on the platform “V pour Verdict”.
This action concerns the Redmi Note 5 and Mi Mix 2S mobile phones. Control tests by the French National Frequencies Agency (ANFR) revealed that the SAR (specific absorption rate) exceeded the European regulatory limit of 2.0 W/kg for the head in the case of the Redmi Note 5 and for the trunk in the case of the Mi Mix 2S.

For over 20 years, cell phone users have been knowingly misled about their true levels of exposure to radiofrequency (RF) waves under real conditions of use in contact with the body. Consumers have been doubly misled by not having been informed by the public authorities to keep the phone away from the body.
This issue concerns all of us and those we love. Most of us have cell phones. We hold them against our heads, keep them switched on in a pants or shirt pocket or tucked in a bra. Many of us are unaware that cell phone manufacturers are testing phones at a certain distance from the body, not in the ways that most of us use them, touching the body. These same manufacturers warn us to keep the phone at a distance from the body.
The authorities have been lax in implementing public health campaigns and recommendations to reduce RF exposure, especially regarding children, pregnant women and medically sensitive populations who are more vulnerable to these waves.

Finally, the public rapporteur considered that it was also sovereign that the court decided whether or not to order the production of the original reports for comparison with the data published online.

A landmark Ninth Circuit Court of Appeals upheld the City of Berkeley’s cell phone right to know ordinance rejecting industries argument that the ordinance violates the first amendment. The Berkeley ordinance requires retailers to inform consumers that cell phones emit radiation and that “if you carry or use your phone in a pants or shirt pocket or tucked into a bra when the phone is ON and connected to a wireless network, you may exceed the federal guidelines for exposure to RF radiation.” In upholding this decision, the panel concluded that the public health issues at hand were “substantial” and that the “text of the Berkeley notice was literally true,” and “uncontroversial.”
Further, the panel determined that the Berkeley ordinance did not constitute preemption.
“Far from conflicting with federal law and policy, the Berkeley ordinance complemented and enforced it.”

The Berkeley ordinance requires retailers to inform consumers that cell phones emit radiation and that “if you carry or use your phone in a pants or shirt pocket or tucked into a bra when the phone is ON and connected to a wireless network, you may exceed the federal guidelines for exposure to RF radiation.” In upholding this decision, the panel concluded that the public health issues at hand were “substantial” and that the “text of the Berkeley notice was literally true,” and “uncontroversial.”Further, the panel determined that the Berkeley ordinance did not constitute preemption.
“Far from conflicting with federal law and policy, the Berkeley ordinance complemented and enforced it.”

Wireless association CTIA has failed again to get the City of Berkeley to stop warning people that using a cell phone could expose them to radiation. As part of the long-running debate over health concerns in using mobile phones, Berkeley's "Right to Know" ordinance, which came into effect in 2016, was upheld by a court Tuesday.
Berkeley had been enforcing a city ordinance that required phone retailers to inform prospective buyers that carrying phones in certain ways, like in pants pockets or bras, could cause them to exceed the FCC's guidelines for radio frequency radiation maximum exposure. CTIA had argued that this violated the First Amendment, blocking retailers' freedom of speech by requiring them to post "inflammatory" messages.

After XIAOMI, a new complaint filed against HMD GLOBAL OY (NOKIA) by the association PHONEGATE ALERT and a new collective action launched
While a first complaint was filed on April 15, 2019 against the Chinese mobile phone manufacturer XIAOMI, a second complaint* is now being filed against the manufacturer HMD GLOBAL OY. Since the end of 2016, the Finnish company has been marketing NOKIA mobile phones, having been granted a license to use its brand.
We explain the reasons for this complaint and its objectives.

On 30 January, 2019, an Italian Court in the city of Monza, Italy ruled that the Acoustic Neuroma brain tumor of an airport employee was caused by exposure to the radiation from a cell phone he used for over 10 years for his work. The court determined that the tumor has permanently incapacitated him, and ruled it to be an occupational disease. PRESS HERE for the Court’s Decision.
This is the fourth case in which the courts in Italy determined that an Acoustic Neuroma type brain tumor was caused by a cell phone, and the fifth court to make such ruling as in the first case the court decision was appealed and later confirmed by Italy’s Supreme Court.
